1. Agreement to these Terms

These Terms of Service govern your use of the website www.impacthvac.com, our text messaging program, and the heating, cooling, and related services provided by Impact Heating & Cooling ("Impact," "we," "us," or "our"), 12295 Pennsylvania St., Thornton, CO 80241.

By visiting our website, booking a service, signing a service agreement, or opting in to receive text messages, you agree to these Terms and to our Privacy Policy at https://impacthvac.com/privacy-policy/. If you do not agree, please do not use our website or services.

2. SMS / Text Messaging Terms

Program name: Impact Heating & Cooling Customer Notifications

Program description: When you opt in, Impact Heating & Cooling will send you text messages related to your service, including appointment confirmations and reminders, technician on-the-way alerts, estimates and invoices, payment receipts, maintenance and service plan reminders, follow-ups after a visit, and responses to your questions. If you separately opt in to promotional messages, we may also send occasional offers and seasonal tune-up promotions.

How you opt in: You may opt in by checking the SMS consent box on our website forms, by giving verbal or written consent when booking with our team, or by texting us first at (720) 773-5865. Consent to receive text messages is not a condition of purchasing any goods or services.

Message frequency: Message frequency varies based on your service activity. Customers typically receive 1 to 10 messages per month.

Cost: Message and data rates may apply. Check with your mobile carrier for details about your plan.

How to opt out: You can cancel at any time. Reply STOP to any message to unsubscribe. You will receive one final message confirming you have been unsubscribed, and no further messages will be sent. You may also reply CANCEL, END, QUIT, UNSUBSCRIBE, or STOPALL. To rejoin, reply START or opt in again through any method above.

Carrier disclaimer: Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission from your network operator.

Supported carriers: Supported carriers include AT&T, T-Mobile, Verizon, and most other major U.S. carriers. Carrier support may change.

Your mobile information: We do not sell, rent, or share your mobile phone number or text messaging opt-in data and consent with third parties or affiliates for their marketing or promotional purposes. Mobile information may be shared only with service providers who help us deliver messages (such as our messaging and field service software providers), and only for that purpose. Eligibility: You must be at least 18 years old and the account holder or authorized user of the mobile number you provide.

Changing numbers: If you change or deactivate the mobile number you gave us, please notify us or reply STOP from that number so messages are not sent to a new owner.

3. Services, Estimates, and Payment

Estimates. Estimates are based on conditions visible at the time of inspection and are valid for 30 days unless stated otherwise. Hidden conditions found once work begins (such as damaged ductwork, electrical issues, or code corrections) may require a revised estimate, which we will review with you before proceeding.

Scheduling and access. Arrival windows are estimates. You agree to provide safe access to equipment and work areas, and to have an adult (18+) present during service.

Cancellations. Please give at least 24 hours' notice to cancel or reschedule. Cancellations made with less than 24 hours' notice, and missed appointments, will be charged our standard trip fee.

Payment. Payment is due upon completion of work unless otherwise agreed in writing. Approved financing is governed by the lender's own terms. Balances not paid within 30 days of the due date will incur a late charge of 1.5% per month on the unpaid balance. Accounts referred to collections will also be responsible for collection costs of up to 15% of the unpaid balance, plus reasonable attorneys' fees, as permitted by Colorado law.

Service plans. Maintenance memberships, including the P3 Preferred Partner Program and Platinum Service Plan, are governed by the plan agreement you sign, including its renewal and cancellation terms.

4. Warranties

Equipment is covered by the manufacturer's warranty, subject to the manufacturer's registration and maintenance requirements. For details on Impact's labor warranty, see our website at www.impacthvac.com. Warranties do not cover damage from misuse, lack of maintenance, power surges, acts of nature, or work performed by others.

5. Limitation of Liability

To the fullest extent permitted by law, Impact is not liable for indirect, incidental, or consequential damages, including loss of use or property damage not caused by our negligence. Our total liability for any claim related to a service will not exceed the amount you paid for that service.

6. Website Use

Content on www.impacthvac.com is provided for general information and may change without notice. You may not use our website or messaging channels for any unlawful purpose or to send spam or abusive content.

7. Governing Law

These Terms are governed by the laws of the State of Colorado. Any dispute will be resolved in the state or federal courts located in Adams County, Colorado.

8. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of our website, services, or text messaging program after an update means you accept the revised Terms.
